Chapter 1 - General Provisions
Article 1 (Purpose)
These Terms of Service (“Terms”) set forth the conditions for use of domain registration and related services (collectively, “Services”) provided by JP?Domains.com (“Company”). All customers (“Registrant”) agree to these Terms upon ordering or using the Services.
Article 2 (Definitions)
- Registrant: the individual or entity listed as the holder of a domain name.
- Reseller: a third party that offers the Services to its own clients.
- Partner: a party with a formal business agreement with the Company to resell or promote the Services.
- Client: the Registrant of a domain managed through a Reseller or Partner.
- Registry: the official operator of a top?level domain (TLD), such as JPRS for .JP.
Article 3 (Changes to Terms)
The Company may revise these Terms at any time. Changes are effective upon posting on the Company’s website. Continued use of the Services after such posting constitutes acceptance of the revised Terms.
Chapter 2 - Domain Registration
Article 4 (Eligibility)
Domain registration is subject to eligibility requirements of the applicable Registry. For certain .JP domain types, proof of eligibility (e.g., corporate registration documents) may be required.
Article 5 (Accuracy of Information)
The Registrant must provide accurate, complete, and up?to?date information at registration and throughout the domain term. Failure to do so may result in suspension, deletion, or other action as permitted by these Terms or Registry policy.
Article 6 (Registry Rules)
All registrations are subject to the rules and policies of the applicable Registry. In the event of a conflict between these Terms and Registry rules, the Registry rules shall prevail.
Chapter 3 - Use of Services
Article 7 (General Responsibilities)
The Registrant is responsible for all activities conducted under their account, maintaining the security of login credentials, and complying with all applicable laws and regulations.
Article 8 (Prohibited Activities)
The Registrant shall not use the Services for unlawful purposes, including but not limited to:
- Distributing malware or spam;
- Hosting or promoting illegal content;
- Infringing intellectual property rights;
- Engaging in phishing, fraud, or other deceptive practices.
Article 9 (Resellers and Partners)
- Resellers and Partners must ensure their Clients comply with these Terms.
- If a Client contacts the Company directly in a dispute, ultimatum, or similarly urgent situation where the Reseller or Partner has failed to respond or act, the Company reserves the right, at its sole discretion, to provide access to or transfer the domain directly to the Client, notwithstanding the Reseller or Partner relationship.
- Before taking such action, the Company may:
- Require written notice or demand from the Client;
- Verify the Reseller or Partner’s inaction or delay;
- Provide notice to the Reseller or Partner where reasonably possible.
- The Company’s decision under this Article is final.
Chapter 4 - Fees and Payment
Article 10 (Service Fees)
Fees for the Services are listed on the Company’s website and may be updated at any time. All fees are payable in Japanese Yen or United States Dollars and subject to consumption tax where applicable.
Article 11 (Refunds and Cancellations)
Unless otherwise specified, domain registration fees are non?refundable once a domain is successfully registered. Partial refunds for certain domain categories may be granted at the Company’s discretion and subject to Registry rules.
Chapter 5 - Suspension and Termination
Article 12 (Suspension)
The Company may suspend Services without prior notice in cases including, but not limited to:
- Non?payment;
- Violation of these Terms;
- Fraudulent or illegal activity;
- Abuse or security threats to the network.
Article 13 (Termination)
The Company may terminate Services if:
- The Registrant becomes ineligible for the domain;
- The Registrant fails to remedy a violation within a reasonable period after notice (where practicable);
- Required by the Registry or by applicable law.
Chapter 6 - Liability and Indemnification
Article 14 (Limitation of Liability)
To the maximum extent permitted by law, the Company’s aggregate liability arising out of or relating to the Services is limited to the total amount paid by the Registrant for the Services in the twelve (12) months preceding the event giving rise to the claim. The Company is not liable for loss of data, loss of business, consequential, incidental, special, punitive, or indirect damages.
Article 15 (Indemnification)
The Registrant shall indemnify, defend, and hold the Company harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from the Registrant’s use of the Services or violation of these Terms.
Chapter 7 - Privacy and Data Protection
Article 16 (Personal Information)
The Company handles personal information in accordance with the Act on the Protection of Personal Information (APPI) and other applicable laws and regulations.
Article 17 (Data Use)
Personal information may be shared with Registries, service providers, law enforcement, or other third parties where required by law, Registry policy, or to provide the Services.
Chapter 8 - Domain Services
Article 18 (Scope of Domain Services)
The Company provides domain-related services including, without limitation: availability checks, registration, registrar change/transfer, renewal, deletion, re-registration where permitted, update of registration data, name server changes, host (glue) registration and updates, name server deletion, and other ancillary services necessary to deliver the foregoing.
Article 19 (Applications and Procedures)
- Use and applications shall follow the procedures and technical requirements specified by the Company and are subject to applicable fees posted by the Company.
- The Registrant is responsible for the accuracy and completeness of each request and for any actions taken under their account.
Article 20 (Registration)
- The Company does not warrant availability of a requested domain at any stage. The Company is not liable for unavailability or conflicts.
- The Registrant shall ensure their chosen domain does not infringe third?party rights and complies with applicable laws and policies.
- The Registrant must provide accurate, complete, and current information for registration and keep it updated throughout the term.
- Registration data may be published via WHOIS or successor services and disclosed to applicable registries (e.g., JPRS for .JP), ICANN or other authorities, law enforcement, and service providers as required by policy or law.
- The Company may correct manifest errors or implement registry?required changes to registration data in order to comply with policy or law. Where reasonably possible, the Company will notify the Registrant.
Article 21 (Registration Data Requirements)
- At minimum, the Registrant shall provide the following and update it promptly upon changes: name, postal address, email address, telephone (and fax, if available); domain name; and the corresponding details for administrative, billing, and technical contacts.
- Providing inaccurate or unreliable information, failing to update information, or failing to respond to inquiries regarding accuracy constitutes a material breach and may result in cancellation, suspension, or transfer as permitted by policy or law.
- The Company will take reasonable precautions to protect personal information and handle it in accordance with Chapter 7 (Privacy and Data Protection).
Article 22 (Renewal)
- The Registrant must complete renewal following the procedures and deadlines specified by the Company and/or applicable registry.
- Failure to renew by the deadline may result in deletion pursuant to registry timelines. For general?purpose .JP domains, additional month?end timing rules may apply; renewal cut?offs and processing windows are governed by the JPRS schedule.
- The Company is not responsible for any loss resulting from expiration, deletion, or failure to renew, and has no obligation to prevent deletion or re?register a deleted domain.
Article 23 (Recovery / Redemption)
- Recovery options (including any "redemption" period and fees) vary by TLD and registry policy. For .JP categories, recovery windows and fees are subject to JPRS timelines and may require payment of both renewal and a registry?specified redemption fee.
- After the applicable recovery period ends, the domain may become available for new registration pursuant to registry rules.
Article 24 (Transfers Out)
- Upon transfer of a domain away from the Company, the Company is not responsible for the domain once it is no longer under the Company's control.
Article 25 (Transfers In)
- Domains transferred to the Company are subject to these Terms and to applicable registry rules. The Registrant must provide accurate information and acknowledge any registry-specific renewal requirements or limitations on transfer timing.
- Certain TLDs may require the domain to have been renewed at least once or to meet other conditions before transfer to another registrar; registry policy prevails.
Article 26 (Editing Registration Information / WHOIS)
- The Registrant is responsible for the accuracy of WHOIS/registration data and for supplying documentation or identification if required by a registry or policy authority.
- Rules for updating WHOIS vary by TLD. For .JP categories, the JPRS policies apply; other TLDs follow ICANN or the respective country registryfs policies.
Article 27 (Operation of Domain Names)
- The Registrant is responsible for the operation, use, and management of their domain name(s), including compliance with these Terms and applicable law.
- If the Company cannot contact the account holder, the Company may attempt to contact the registrant or other contacts listed in the registration data.
- Where the Company provides a local presence/trustee service, content illegal under Japanese law may result in suspension until the Registrant appoints their own local representative.
Article 28 (Disputes and Claims)
The Registrant shall indemnify the Company and any applicable registry for disputes or claims arising from the use or registration of the domain name and shall not implicate them as parties to such disputes, except where required by law.
Article 29 (Refusal, Suspension, or Removal)
- The Company may refuse, remove, suspend, cancel, transfer, modify, or otherwise act on a domain where: these Terms or applicable law/policy are or may be violated; fraud or abuse is suspected; required documents are not provided; payment is evaded; dispute?resolution policies apply; system integrity requires action; or as otherwise permitted by applicable policy or law.
- Actions may be taken without prior notice where necessary or required. The Company and applicable registries are not liable for losses arising from such actions as permitted by law.
Article 30 (Termination of Domain Services)
- The Company may terminate domain services where continued provision is impracticable, where an underlying agreement with a registry or service provider ends, or where otherwise permitted by these Terms.
- Payments already made are non?refundable unless expressly stated otherwise in these Terms or required by law.
Chapter 9 - Miscellaneous
Article 31 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. The exclusive jurisdiction for any dispute shall be the Tokyo District Court.
Article 32 (Language)
If these Terms are provided in multiple languages, the Japanese version shall prevail in the event of any inconsistency or conflict.
